Terms and Conditions for Broker Registration 1. Acceptance of Terms: By registering as a broker on Brokerstack.in ("Platform"), you agree to be bound by these Terms and Conditions. The Platform is an online directory, lead-generation, and tech-enablement service connecting property buyers, tenants, and sellers with verified real estate professionals. Brokerstack does not act as a real estate broker, does not negotiate property deals, and does not facilitate financial transactions directly between buyers and sellers.

2. Eligibility and RERA Compliance:
• Legal Capacity: You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872.
• RERA Registration: Brokerstack mandates strict compliance with the Real Estate (Regulation and Development) Act, 2016 (RERA). To unlock "Verified" status on the Platform, you must provide a valid and active unique RERA registration number.
• Authorization: If you are registering on behalf of a real estate agency or firm, you represent that you are legally authorized to bind that business entity to these terms.

3. Account Registration & Security:
• Accuracy of Information: You must provide your complete legal name (or agency designation), primary city of operation, and an active WhatsApp-enabled mobile number (including country code) for system routing.
• Data Privacy & Contact: By registering, you explicitly authorize Brokerstack to send transactional notifications, leads, and OTPs via Meta WhatsApp Cloud APIs, SMS, and Email, superseding any prior registration with the National Do Not Call Registry (NDNC) or DND services.

4. Subscription Plans & Service Tiers: Access to the Platform’s features is governed by your selected subscription plan:
• Starter Plan (Free): Limited to one locality, 5 exclusive listing slots, standard RERA verification badge, basic analytics, and OTP-verified lead access (pay-per-lead credits).
• Featured Pro (₹2,499/month or ₹22,491/year): Unlocks 10 localities, 50 premium showcase slots, direct WhatsApp connections, shareable magical links, B2B co-broking board access, ₹3,000 value free lead credits, featured search placement, and full analytics & tracking.
• Enterprise VIP (Custom Pricing): Unlimited localities & listings, custom subdomain identity, white-labeled media assets, team/multi-agent billing matrix, direct API hub, dedicated account manager, and server level prioritization.
• Modifications: Brokerstack reserves the right to modify subscription pricing or tier limits with prior notice.

5. The Pay-Per-Lead Credit Architecture:
• Lead Generation: General inquiries submitted by users through the generic "Post Your Requirement" matrix are pooled in the database. Customer contact details are masked by default.
• Wallet System: You must use pre-purchased 'Lead Credits' to unlock masked consumer data.
• Credit Deductions:
    - Buyer/Tenant Leads: Cost one (1) standard credit token to unlock.
    - Verified Seller Leads: High-value property owners listing asset details require a deduction of three (3) credit tokens.
• Refunds: Lead credits are non-refundable. Brokerstack makes no guarantees regarding the ultimate conversion or financial capability of the lead, though basic OTP verification may be applied to filter spam.

6. Magical Link Catalogue & Content Protection:
• Digital Microsites: Premium and Enterprise brokers may use the Platform to generate custom URL slugs (/share/broker_slug/property_id) to share property portfolios with clients.
• Content Ownership & Accuracy: You retain ownership of your property images and text. However, you are solely responsible for ensuring the property details and pricing are accurate and do not infringe on third-party rights.
• Image Watermarking: To prevent unauthorized duplication by competitors, Brokerstack automatically processes and applies a permanent digital watermark to all property images uploaded to your database storage.

7. Prohibited Activities: While using the Platform, you strictly agree NOT to:
• Publish fraudulent, stale, or "bait-and-switch" property listings.
• Share or distribute your Brokerstack account login credentials or internal database leads with external unregistered brokers.
• Bypass the platform’s lead tracking attribution by publishing your phone number in hidden text fields or watermark imagery.
• Use automated scripts, scrapers, or bots to extract directory data or other brokers' contact details.

8. Limitation of Liability and Termination:
• Service Interruptions: Brokerstack relies on third-party nodes (e.g., WhatsApp APIs, AWS/Supabase storage). We do not guarantee 100% uptime and are not liable for lost commissions due to technical downtime or delayed notifications.
• Dispute Resolution: Any property-related disputes are strictly between you and the customer.
• Account Suspension: Brokerstack reserves the right to downgrade your status to 'Suspended' or permanently delete your account if you provide false RERA credentials, receive consistent consumer complaints, or violate these Terms and Conditions. These terms shall be governed by the laws of India.
